Nutzungsbedingungen

1. Allgemeines

(1) Diese Nutzungsbedingungen regeln die Bedingungen, unter denen die Benutzung des Internetangebotes der einheitberlin GmbH (nachfolgend: einheitberlin) erfolgt.

(2) Abweichende Geschäftsbedingungen des Nutzers finden keine Anwendung, es sei denn, diesen wurde ausdrücklich zugestimmt.

(3) Die Registrierung bei einheitberlin ist nur natürlichen Personen möglich, die das 14. Lebensjahr vollendet haben. Juristische Personen oder Personengesellschaften haben keinen Anspruch die Registrierung als Nutzer bei einheitberlin. einheitberlin behält sich vor, die Übermittlung geeigneter Nachweise über das Vorliegen dieser Voraussetzungen vom Nutzer zu fordern. Der Nutzer hat vor Abschluss der Registrierung die Möglichkeit, von den Bestimmungen dieser AGB Kenntnis zu nehmen, diese auszudrucken und/oder zu speichern.
2. Leistungen von einheitberlin

(1) einheitberlin bietet den Nutzern mit seinem Internetangebot die Möglichkeit, eine Suchanfrage zu einer Vornamen-/Nachnamenkombination zu starten, bei der Informationen aus dem Internet, die allgemein zugänglich sind, in aggregierter Form dargestellt werden. Zudem können Suchergebnisse zu Informationen zu Personen nach unterschiedlichen Themen oder Kriterien abgefragt werden.

(2) einheitberlin bietet registrierten Nutzern die Möglichkeit, selbst ein persönliches öffentliches Web-Profil (Exposé) mit eigenen Informationen zu erstellen.

(3) einheitberlin bietet registrierten Nutzern die Möglichkeit, Suchergebnisse oder Informationen zu anderen registrierten Nutzern nach verschiedenen Kriterien zu bewerten.

(4) einheitberlin bietet registrierten Nutzern die Möglichkeit, elektronisch mit anderen registrierten Nutzern Kontakt aufzunehmen, Kontakte zu bestätigen und miteinander zu kommunizieren.

(5) Die genannten Dienste können jederzeit von einheitberlin geändert oder in abgeänderter Weise angeboten werden. Ferner bleibt eine Erweiterung um zusätzliche Dienste und Leistungen vorbehalten.

(6) einheitberlin ist bemüht, die angebotenen Leistungen möglichst unterbrechungsfrei zu erfüllen. Eine Verpflichtung, eine jederzeitige Verfügbarkeit der Leistungen oder eines Teils der Leistungen zu gewährleisten, besteht jedoch nicht.

(7) Die Nutzung von einheitberlin ist derzeit kostenfrei. einheitberlin behält sich das Recht vor, bestimmte erweiterte Leistungen (z.B. sog Premiumdienste) kostenpflichtig anzubieten. Ein kostenpflichtiges Nutzungsverhältnis entsteht nicht ohne Zustimmung des Nutzers.
3. Pflichten des Nutzers

(1) Der Nutzer ist verpflichtet, Informationen, die im Rahmen der Nutzung von einheitberlin von ihm angegeben werden, wahrheitsgemäß zu machen. Der Nutzer ist insbesondere verpflichtet, nur Angaben in seinem Web-Profil (Exposé) aufzunehmen, die tatsächlich zu seiner Person zuzuordnen sind.

(2) Der Nutzer ist verpflichtet, bei der Nutzung die geltenden Gesetze einzuhalten.

(3) Der Nutzer ist verpflichtet, E-Mails und andere elektronische Nachrichten, die er im Rahmen der Inanspruchnahme des Dienstes von einheitberlin erhält, vertraulich zu behandeln und nicht ohne Zustimmung des Kommunikationspartners an Dritte zu übermitteln.

(4) einheitberlin ist keine anonyme Plattform. Der Nutzer ist verpflichtet, bei der Registrierung seinen bürgerlichen Namen anzugeben. Eine Verwendung von Pseudonymen oder Künstlernamen ist unzulässig.

(5) Jeder Nutzer darf nur ein Web-Profil (Exposé) bei einheitberlin unterhalten. Eine Mehrfachregistrierung ist unzulässig.

(6) Dem Nutzer ist es untersagt, die Leistungen von einheitberlin missbräuchlich in Anspruch zu nehmen. Eine missbräuchliche Nutzung liegt insbesondere in folgenden Fällen vor:

die Veröffentlichung oder Verbreitung rechtswidriger, diffamierender, pornografischer oder sonstiger anstößiger Inhalte
die Veröffentlichung oder Verbreitung von urheberrechtlich geschützten Werken (z.B. Fotos) Dritter
die Nötigung, Bedrohung oder Beleidigung von Personen
die Nutzung/Veröffentlichung/Verbreitung von urheberrechtlich geschütztem Material
die Werbung für fremde Produkte oder die Nutzung von Daten zur Verbreitung von unverlangter Werbung (z.B. SPAM)
die gewerbliche Nutzung des Dienstes, wenn diese so ausgestaltet ist, dass andere Nutzer belästigt werden. Eine belästigende Nutzung kann insbesondere dann vorliegen, wenn andere Nutzer aufgefordert werden, kostenpflichtige Mehrwertdiensterufnummern (z.B. 0900-Nummern u.ä.) zu nutzen.
die Veröffentlichung von Inhalten, die nicht wahrheitsgemäß sind (vgl. Ziff. 3 Abs. 1)

(7) einheitberlin ist berechtigt, vom Nutzer veröffentlichte Inhalte, die rechtswidrig und/oder missbräuchlich sind, unverzüglich zu löschen. Der Nutzer ist verpflichtet, dem Betreiber den aus der missbräuchlichen Nutzung entstehenden Schaden zu ersetzen.

(8) Der Nutzer stellt einheitberlin von allen Verpflichtungen und Ansprüchen, die sich aus Schäden wegen des Ausfalls von Dienstleistungen für Nutzer, wegen der Verletzung von Urheber- und Markenrechten, übler Nachrede, Beleidigung, Verletzung von Persönlichkeitsrechten oder sonstiger Rechte Dritter frei. Der Nutzer ist weiter verpflichtet, einheitberlin den durch eine missbräuchliche Nutzung entstehenden Schaden zu ersetzen. Dies beinhaltet insbesondere auch die erforderlichen Kosten der Abwehr von Forderungen oder sonstiger Ansprüche und die Kosten der Rechtsverfolgung (insbesondere der Kosten der Inanspruchnahme eines Rechtsanwalts).

(9) Der Nutzer räumt einheitberlin ein einfaches Nutzungsrecht an den von Nutzern hochgeladenen Inhalten und Medieninhalten (Texte, Fotos, Videos etc.) zur Speicherung, Vervielfältigung und der ganz oder teilweisen öffentlichen Zugänglichmachung für Zwecke der Erbringung der Leistung von einheitberlin ein.
4. Sanktionen

(1) einheitberlin behält sich bei Pflichtverletzungen des Nutzers vor, den Nutzer ohne vorherige Ankündigung vom Dienst zu sperren und seine Daten zu löschen. Die Geltung von Schadenersatzansprüchen oder sonstigen Maßnahmen bleibt vorbehalten.

(2) einheitberlin behält sich vor, vom Nutzer veröffentlichte Inhalte oder Daten ganz oder teilweise zu löschen, wenn eine Pflichtverletzung des Nutzers vorliegt.
5. Widerrufsrecht

(1) Widerrufsbelehrung

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Vertragsschluss und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs. Der Widerruf ist zu richten an:

Widerrufsfolgen

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Dies kann dazu führen, dass Sie die vertraglichen Zahlungsverpflichtungen für den Zeitraum bis zum Widerruf gleichwohl erfüllen müssen. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung, für uns mit deren Empfang.
Besondere Hinweise

Ihr Widerrufsrecht erlischt vorzeitig, wenn der Vertrag von beiden Seiten auf Ihren ausdrücklichen Wunsch vollständig erfüllt ist, bevor Sie Ihr Widerrufsrecht ausgeübt haben.

(2) Mit der Registrierung bei einheitberlin bietet einheitberlin seine Dienstleistung vollständig zur Nutzung an.
6. Haftung von einheitberlin - Haftungsbeschränkung

(1) einheitberlin haftet bei Vorsatz oder grober Fahrlässigkeit für alle von einheitberlin verursachten Schäden unbeschränkt.

(2) Bei leichter Fahrlässigkeit haftet einheitberlin im Fall der Verletzung des Lebens, des Körpers oder der Gesundheit unbeschränkt.

(3) Im Übrigen haftet einheitberlin nur, soweit einheitberlin eine wesentliche Vertragspflicht verletzt hat. Als wesentliche Vertragspflichten werden dabei abstrakt solche Pflichten bezeichnet, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertrauen darf. In diesen Fällen ist die Haftung auf den Ersatz des vorhersehbaren, typischerweise eintretenden Schaden beschränkt.

(4) Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

(5) Soweit die Haftung von einheitberlin nach den vorgenannten Vorschriften ausgeschlossen oder beschränkt wird, gilt dies auch für Erfüllungsgehilfen der einheitberlin GmbH.
7. Datenschutz

(1) Die für die Durchführung und Abwicklung der Dienste und Leistungen von einheitberlin erforderlichen personenbezogenen Daten des Nutzers werden nach Maßgabe der gesetzlichen Bestimmungen erhoben und verarbeitet.

(2) Der Nutzer kann freiwillige Angaben bei der Nutzung von einheitberlin machen. Mit der Eingabe der Daten erklärt der Nutzer seine Einwilligung zur Verarbeitung und Nutzung der Daten, soweit dies für die Erbringung der Leistungen von einheitberlin oder zum Betrieb des Dienstes erforderlich ist. Der Nutzer kann die freiwillig angegebenen Daten jederzeit selbst löschen und so eine weitere Verarbeitung der Daten beenden. Darüber hinaus kann der Nutzer seine erklärte Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen.
8. Beendigung des Nutzungsverhältnisses

(1) Der Nutzer kann jederzeit ohne Angabe von Gründen sein Nutzungsverhältnis kündigen. Die Kündigung soll über das Kontaktformular von einheitberlin erfolgen. Bei der Kündigung sind der Vor- und Zuname sowie die auf einheitberlin registrierte E-Mail-Adresse des Nutzers anzugeben Der Betreiber wird innerhalb einer Woche den gesamten, unter dem Web-Profil (Exposé) des Nutzers gespeicherten Datensatz vollständig löschen. Eine Kündigung kann auch in Schriftform oder Textform erklärt werden. Die Bearbeitungszeit kann sich in diesem Fall verlängern.

(2) einheitberlin kann das Nutzungsverhältnis mit dem Kunden beenden, wenn dieser gegen seine Pflichten (Ziff. 3) verstoßen hat. Ferner kann eine Kündigung aus wichtigem Grund erfolgen. Ein wichtiger Grund für einheitberlin liegt insbesondere dann vor, wenn die Fortsetzung des Vertragsverhältnisses für den Betreiber unter Berücksichtigung aller Umstände des Einzelfalls und unter Abwägung der Interessen von einheitberlin und des Nutzers nicht zumutbar ist.
9. Änderungen

einheitberlin behält sich vor, Änderungen an diesen Nutzungsbedingungen vorzunehmen. Die Nutzer werden per E-Mail über Änderungen an den Nutzungsbedingungen informiert. Die Änderungen werden zwischen den Parteien wirksam, wenn der Nutzer nicht binnen 6 Wochen nach Zugang der Information den Änderungen widerspricht. einheitberlin wird in der E-Mail gesondert auf die Widerspruchsmöglichkeit und deren Frist hinweisen. Widerspricht ein Nutzer den Änderungen an den Nutzungsbedingungen, hat einheitberlin das Recht, das Nutzungsverhältnis zum Zeitpunkt des geplanten Inkraftretens der Änderungen zu kündigen und zu beenden.
10. Schlussbestimmungen

(1) Es gilt das Recht der Bundesrepublik Deutschland, wobei die Geltung des UN-Kaufrechts ausgeschlossen wird.

(2) Sollten Bestimmungen dieser Allgemeinen Geschäftsbedingungen unwirksam sein oder werden, so berührt dies die Wirksamkeit der übrigen Bestimmungen nicht.

You also understand and agree that the service may include advertisements or links to third party websites. You also understand and agree that the service may include certain communication from einheitberlin, such as service announcements, administrative messages and various emails, which may include attachments.

You understand and agree that einheitberlin assumes no responsibility for the timeliness, deletion, misdelivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees. In addition, you must provide and are responsible for all equipment necessary to access the Service.

Due to the Children's Online Privacy Protection you must be at least seven (7) years of age to use this service.

We may modify or terminate our services from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time without notice. Therefore you accept the obligation to review these Terms of Service prior to each use of the einheitberlin website. No third-party beneficiaries

You agree that, except as otherwise expressly provided in this agreement, there shall be no third-party beneficiaries to this agreement.

Non-commercial use by members

all organizations, companies, and/or businesses alike may not become members and should not use the einheitberlin service or the website for any purpose. The einheitberlin website service is meant for personal use of the individual members only, and may not be used in connection with any commercial activities or endeavours. The following include illegal and/or unauthorized uses of the website: collection of usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited emails and unauthorized framing of or linking to the website will be investigated thoroughly, and the appropriate legal actions will be taken, including without limitation, criminal, civil and injunctive redress.

einheitberlin occasionally receives requests from people to remove search results from its indices. Although einheitberlin reserves the right to address such requests individually, the general approach that einheitberlin takes reflects the following principles:

einheitberlin's search results consist of information that has been identified, indexed and compiled through an automated process with no advance review by human beings. Given the enormous volume of web site information added, deleted, and changed on a frequent basis, einheitberlin cannot and does not screen anything made available through its indices. For each web site reflected in einheitberlin's indices, if either (i) a site owner restricts access to his or her web site or (ii) a site is taken down from the web, then, upon receipt of a request by the site owner or a third party in the second instance, einheitberlin will at its sole discretion consider on a case-by-case basis requests to remove the link to that site from its indices. Posting Community Generated Material on our Sites

Certain areas of einheitberlin allow users to post, add, or upload information, data, text, photographs, graphics, messages and/or other content ("Postings"). You acknowledge and agree that Postings and any and all liability arising from Postings are the sole responsibility of the user who posted the content ("Poster"), and not einheitberlin. einheitberlin does not control the Postings and does not guarantee the accuracy, integrity or quality of any Postings.

You understand that by using the einheitberlin Services you may be exposed to Postings that are offensive, indecent or objectionable. Under no circumstances will einheitberlin be liable in any way for any Postings, including, but not limited to, for any errors, omissions or misrepresentations in any Postings, or for any loss or damage of any kind incurred as a result of the use of, or arising from, any Postings.

If you do choose to post content on einheitberlin, please do not do so unless you understand that your postings will be available publicly. You should not assume that you are anonymous online and cannot be identified by your postings. You agree that all of your postings will comply with the requirements of this agreement.

You agree not to use einheitberlin to:

Post any Posting that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
Harm or threaten to harm users in any way;
Stalk or otherwise harass any other person or entity;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Create false or fictional search results on einheitberlin;
Post any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation except in areas that are expressly designated by einheitberlin for such purpose;
Disseminate or transmit any content that infringes or violates any party's copyright, trademark, trade secret, patent or other proprietary right, including, but not limited to, using third party copyrighted materials, without appropriate permission, using third party trademarks without appropriate permission or attribution, or using or distributing third party information (whether or not protected as a trade secret) in violation of a duty of confidentiality;
Disseminate or transmit any worms, viruses or other harmful, disruptive or destructive files, code or programs;
Violate any law (whether local, state, national, or international), whether or not intentionally;
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Posting;
Post any content that you do not have a right to under any law or under contractual or fiduciary relationship (which includes inside information, proprietary or confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
Interfere with or disrupt the einheitberlin Services, or servers or networks connected to einheitberlin, or disobey any requirements, procedures, policies, or regulations of networks connected to;

Engage in any activities that would violate the personal privacy rights of others, including but not limited to, collecting and distributing information about Internet users without their permission, except as permitted by applicable law; or post any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment. You acknowledge that einheitberlin does not pre-screen postings, but that einheitberlin has the right, but not the obligation, to refuse to make available, to modify or to remove any postings or portions of postings in its sole discretion and at any time without notice to the poster, regardless of whether those postings violate the terms of this agreement or are otherwise objectionable. You agree that your use of any posting is at your own risk, including any reliance on the accuracy, completeness, or usefulness of the posting. You agree that if you rely on any posting submitted to einheitberlin , it is entirely at your own risk. If you choose to provide any postings on our Sites, you agree that einheitberlin may copy, distribute, display, publish, modify or translate such postings for any purpose and in any medium worldwide (including incorporating the postings into einheitberlin databases or any other einheitberlin property, product or service) without any obligation to compensate you or any other third party in any way for any such use. einheitberlin may grant other parties these same rights as to the postings.

einheitberlin Registration

Certain portions of einheitberlin require users to register to obtain certain einheitberlin Services. Registration is limited to one account per user. By registering for these services, you agree to: (a) provide true, accurate, current and complete information about yourself as requested by the einheitberlin registration form (the "Registration Information") and (b) maintain and update the Registration Information to keep it true, accurate, current and complete. In addition to other grounds for suspension or termination of your use of the einheitberlin Services, if you provide any information that is untrue, inaccurate, not current or incomplete, or einheitberlin has reasonable grounds to suspect that information you have provided is untrue, inaccurate, not current or incomplete, einheitberlin has the right to suspend or terminate your access and refuse you any and all use of relevant Site.
Passwords and Security

Access to certain einheitberlin Services require you to choose a user name and password. If you do so, you are responsible for maintaining the confidentiality of your password and account and for logging out of your account at the end of each session. In selecting a user name, you agree that you will not (i) select or use a screen name of another person with the intent to impersonate that person; (ii) use a name subject to the rights of any person without their authorization; or (iii) use a screen name that is offensive to people of ordinary sensitivities, illegal, or infringing. You are fully responsible for all activities that occur under your password or account. You agree (a) to notify einheitberlin immediately of any unauthorized use of your password or account or any other breach of security, and (b) to ensure that you exit from your account at the end of each session. einheitberlin cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
Indemnification of einheitberlin

You agree to indemnify and hold einheitberlin harmless from and against any and all liability, losses, claims, demands, disputes, damages or costs of any kind, including, without limitation, reasonable attorneys' fees and costs of litigation, resulting from or in any way connected with (a) Postings or other content you submit or that are submitted from your account, (b) your use of or reliance on einheitberlin Services, (c) your connection to our Sites, (d) your violation of this Agreement, or (e) your violation of any rights of another party.
Termination of your access to einheitberlin Services

You agree that einheitberlin, in its sole discretion, may terminate your access to the einheitberlin Services, and/or remove, discard or modify any postings or content within the Service, for any reason, including, without limitation, for lack of use or if einheitberlin believes that you have violated or acted inconsistently with the letter or spirit of this agreement.
